1632 Barnett v. Local Union 735
Case No: 1632
2009
Management did not refuse to place Barnett when he returned to work in March 2007. Instead, the parties applied the local seniority agreement to place him on a job in the assembly area that accommodated his restrictions. The wages Barnett lost during the period from March 2007 through August 2008 resulted from his medical condition rather than any discrimination or breach of contract by General Motors. Barnett apparently wanted the ADAPT team to declare that a particular job in Department 534 was within his restrictions, but that is not something he was entitled to insist upon.
