1617 Baxter v. Local Union 659 Joint Council

Case No: 1617

The one issue of substance raised by this appeal is whether the notice postponing the election that was posted by the election committee chairperson confused voters to such an extent that the election results did not reflect the will of the electorate. The record demonstrates that the local union responded to the misleading notice within hours after it was posted. The local union president followed up by having public announcements issued on radio stations throughout the area informing the members that the election was still scheduled for March 13, 2008. No member has come forward in connection with Baxter’s appeal to claim that he or she did not vote because of the announcement that the election had been postponed, so it does not appear that a significant number of members were confused by the notice
