There was no credible evidence that supervisors performed significant bargaining unit work during the temporary shutdown. In addition, the local union’s conclusion that the collective bargaining agreement allowed the company to assign Leaders to work in their departments regardless of seniority was rational. It would be unreasonable for the union to insist that a department operate without a Leader because a higher seniority employee was not scheduled to work.
