1476 Gaston-Kelley v. UAW DaimlerChrysler Dept.

Case No: 1476

2004

Gaston-Kelly has identified a sufficient number of irregularities in the actions taken by the Local Union and the DaimlerChrysler Department to require further inquiry on the part of the International Union to determine that her removal was not for reasons that would violate the UAW Ethical Practices Codes. The case is remanded to the IEB for the purpose of conducting a meaningful investigatory hearing into Gaston-Kelly’s Ethical Practices Compliant against the Local Union President and the Department Director. The IEB is further directed to follow the procedures stated in Article 32, §5, of the Constitution by advising the Chairperson of the PRB and the appellant regarding the progress of the investigation and the disposition of the case. Concurring Opinion filed by Members Brudney, Jones and Weiler.
