The tie in the original presidential race and the closeness of the runoff results warranted strict application of the rule against using the union’s facilities during an election. With the support of the membership so evenly divided, any irregularity had the potential to change the outcome of the election and the perception of a level playing filed was particularly important. There is nothing in the UAW’s election rules or the Constitution that would preclude this remedy.
