1651 Knop v. Local Union 594
Case No: 1651
2010
Knop could not have obtained damages through the grievance procedure for a lost opportunity where it was in his power to avoid the loss by filing a shift preference application. The union had to decide how to distribute a sum of money paid to settle a large number of grievances, some of which undoubtedly involved actual loss of income as a result of contract violations or disciplinary actions. The local committeeperson’s conclusion that Knop was not entitled to a portion of this settlement was rational based on this record.
