1641 Nester et al. v. UAW Heavy Trucks and Engines Dept.

Case No: 1641

2010

The local filed the grievance on behalf of all bargaining unit members to protect its right to participate in setting the qualifications for jobs within the unit. When the company made it plain that the appellants were not going to be allowed to keep their pay raise unless the union agreed to the addition of what it regarded as unwarranted qualifications for their job that would deprive other bargaining unit members of opportunities for promotion, the union had a responsibility to act in the best interest of the entire bargaining unit, even if doing so required it to sacrifice the interests of a smaller group within the unit. It was reasonable and prudent for the union to conclude that a settlement which restored the parties to the positions they held prior to the contract violation was the best result that could be obtained for appellants
