The International President’s refusal to refer Reighard’s appeal to the IEB violates not only the appellate procedures clearly enunciated in the UAW Constitution, but also the principles of fairness and ethical conduct espoused throughout the Constitution. No useful purpose would be served by remanding this appeal to the IEB once again, however, because the merits of the case are clear. There is nothing in the record that would have been likely to convince the IEB to revoke or rescind the President’s refusal to waive the Constitutional time limits. The appeal is therefore dismissed.
