Appellant challenges the decision of the UAW FCA Department to withdraw his termination grievance.  Appellant’s primary contention is that the International Representative handling his grievance incorrectly identified him as an aggressor in the altercation based upon the Representative’s review of the Company’s surveillance video.  It is not the function of the PRB, however, to determine whether or not an appellant is guilty of the offense which led to discharge.  To the extent that Appellant’s role in the incident is open to dispute, the International Union emphasizes that his credibility at arbitration would be undermined by his prior work history showing numerous rule infractions in relatively few years of employment.  Under all the circumstances, it was not irrational for the Union to decide not to arbitrate Appellant’s termination grievance.
