1830 Minney v. International Union, UAW
Case No: 1830
2021
This case involves an appeal of an International Representative’s decision to withdraw a termination grievance. Accordingly, the applicable time limit for filing an appeal under Article 33, §4(c) is 30 days. Appellant was advised by letter that her appeal had been withdrawn but waited nearly five years before filing an appeal. Appellant complains that the International Representative failed to advise her that she had the option to appeal his decision either in his letter to her or in their subsequent telephone conversation. This argument is not persuasive. As the Board has explained in numerous past decisions, UAW members have a responsibility to learn the Constitutional appeal requirements and follow them.
